These Affiliate Program Terms and Conditions (“Agreement”) govern participation in the BestGrabBars Affiliate Program (“Program”) operated by BestGrabBars.com (“Company,” “BestGrabBars,” “we,” “us,” or “our”). By applying for or participating in the Program, you (“Affiliate,” “you,” or “your”) agree to be bound by these Terms and Conditions.

If you do not agree with these Terms and Conditions, you may not participate in the Program.

1. Definitions

Affiliate means an individual or organization approved by BestGrabBars to participate in the Program.

Affiliate Coupon Code means the unique promotional code assigned to an Affiliate that allows customers to receive a discount and allows BestGrabBars to track qualifying purchases.

Commission means the amount earned by an Affiliate for qualifying purchases made through their Affiliate Coupon Code.

Qualifying Purchase means an eligible purchase made on BestGrabBars.com using an Affiliate Coupon Code that:

Is not canceled, refunded, returned, fraudulent, or otherwise invalidated;
Remains completed for at least thirty (30) days after purchase;
Meets all requirements outlined in this Agreement.

Eligible Products means products available for purchase on BestGrabBars.com that qualify for affiliate commissions. BestGrabBars reserves the right to exclude certain products or promotions from commission eligibility.

Website means https://BestGrabBars.com.

2. Affiliate Program Overview

The BestGrabBars Affiliate Program allows approved Affiliates to earn commissions by promoting BestGrabBars products through approved marketing channels.

Upon approval, Affiliates will receive a unique Affiliate Coupon Code to share with their audience.

At launch, the Program provides:

10% discount for customers using an Affiliate Coupon Code
5% commission for Affiliates on qualifying purchases

The Affiliate commission is calculated based on the final discounted purchase price after all applicable discounts have been applied.

Example:

A customer purchases a product priced at $100:

Customer receives 10% discount: $10
Customer pays: $90
Affiliate earns 5% commission: $4.50

BestGrabBars may modify commission rates, customer discounts, or both in the future based on program growth, affiliate performance, sales volume, or other factors.

3. Affiliate Approval

Submission of an application does not guarantee acceptance into the Program.

BestGrabBars reviews each application individually and reserves the right to approve or reject any application at its sole discretion.

Approved Affiliates must provide accurate and complete information during the application process and maintain accurate account information throughout participation. Requested information includes, but is not limited to:

Affiliate’s First and Last Name
Affiliate’s Email Address
Affiliate’s Phone Number
Affiliate’s Company / Organization
Affiliate’s Website and / or Social Media
Affiliate’s Occupation
Affiliate’s Target Audience
Affiliate’s Intended Method of Promoting BestGrabBars

4. Affiliate Coupon Codes

Each approved Affiliate will receive one unique Affiliate Coupon Code.

Affiliates may request a preferred coupon code; however, availability is not guaranteed. If no preferred code is provided or available, BestGrabBars will assign a coupon code.

Affiliate Coupon Codes:

May only be used as permitted under this Agreement;
May not be altered, copied, sold, or misrepresented;
May not be used to falsely represent an affiliation with BestGrabBars;
May only be applied to Eligible Products.

BestGrabBars reserves the right to modify, suspend, or deactivate any Affiliate Coupon Code at any time.

5. Affiliate Commissions and Payments

Affiliates earn commissions on Qualifying Purchases made using their Affiliate Coupon Code.

The initial commission rate is 5% of the final discounted purchase price.

Commissions are not earned on:

Orders placed before Affiliate approval;
Purchases made without the Affiliate Coupon Code;
Purchases made by the Affiliate themselves;
Purchases made by immediate family members or affiliated parties;
Returned, refunded, canceled, fraudulent, or disputed orders;
Orders that otherwise violate this Agreement.

Commissions become eligible for payment after thirty (30) days from the original purchase date.

Payments are issued quarterly on the first business day of each calendar quarter.

There is no minimum payout requirement. All eligible commissions earned during the applicable payment period will be paid.

BestGrabBars reserves the right to delay payment of commissions while investigating suspected fraud, abuse, returns, or violations of this Agreement.

6. Marketing and Advertising Requirements

Affiliates may promote BestGrabBars products through approved channels, including:

Websites;
Blogs;
Social media platforms;
Email marketing;
Educational content;
Other approved promotional methods.

Affiliates must accurately represent BestGrabBars products and may not make false, misleading, or unsupported claims.

Affiliates are responsible for complying with all applicable laws and regulations related to advertising, marketing, and endorsements, including Federal Trade Commission (FTC) disclosure requirements.

Affiliates must clearly disclose their relationship with BestGrabBars when promoting products.

7. Restricted Promotional Activities

Affiliates may not advertise in any way, online or offline, including social media, SEO, or any other paid initiative without the express written permission and approval of BestGrabBars.

This includes bidding on terms such as :

“BestGrabBars”;
“Best Grab Bars”;
Variations, misspellings, or confusingly similar terms;
BestGrabBars trademarks or branded keywords.

Exceptions may only be made with prior written approval from BestGrabBars.

Coupon and Discount Websites

Affiliates may not submit Affiliate Coupon Codes to coupon aggregation websites, browser extensions, or discount platforms without prior written approval from BestGrabBars.

Misrepresentation

Affiliates may not:

Represent themselves as BestGrabBars;
Create websites, profiles, or advertisements designed to appear as official BestGrabBars properties;
Make claims that they are employees, representatives, or owners of BestGrabBars.

8. Use of BestGrabBars Materials

BestGrabBars may provide Affiliates with approved marketing materials, images, product information, logos, or other promotional content.

Affiliates may only use these materials for the purpose of promoting BestGrabBars products through the Affiliate Program.

All trademarks, logos, copyrighted materials, and other intellectual property remain the exclusive property of BestGrabBars.

Affiliates may not modify, reproduce, or distribute BestGrabBars materials outside of approved promotional activities without written permission.

9. Fraud and Abuse

BestGrabBars reserves the right to investigate any activity associated with the Affiliate Program.

BestGrabBars may withhold, deny, reverse, or recover commissions associated with:

Fraudulent purchases;
Self-referrals;
Artificially generated orders;
Orders that are canceled, refunded, charged back, or determined to be fradulent;
Misuse of Affiliate Coupon Codes;
Violations of these Terms and Conditions;
Any activity that violates applicable laws, our Terms and Conditions, or our Privacy Policy;
Any activity that may harm BestGrabBars, its customers, or the integrity of the Program.

BestGrabBars’ determination regarding commission eligibility shall be final.

10. Termination

Either party may terminate Affiliate participation in the Program at any time.

BestGrabBars may immediately suspend or terminate an Affiliate account for violations of this Agreement, fraudulent activity, misuse of promotional materials, misleading marketing practices, or any other reason deemed appropriate by BestGrabBars.

Upon termination:

The Affiliate must stop using their Affiliate Coupon Code;
The Affiliate must stop representing themselves as a BestGrabBars Affiliate;
Outstanding eligible commissions earned prior to termination may still be paid according to the normal payment schedule;
BestGrabBars will immediately deactivate the Affiliate Coupon Code related to the Affiliate.

Any continued communication or promotional activity by the promoter following the terminatino of the agreement, and linked to the BestGrabBars affiliate program, will be reported to the competent authorities. BestGrabBars disclaims all liability for, and is not involved in, any initiatives undertaken in such circumstances.

11. Program Changes

BestGrabBars reserves the right to modify, suspend, or discontinue any part of the Affiliate Program at any time.

Changes may include:

Commission rates;
Customer discount amounts;
Eligible Products;
Payment schedules;
Promotional requirements;
Program rules.

Changes will apply prospectively and will not affect commissions already earned before the effective date of the changes.

Continued participation in the Program after changes are posted constitutes acceptance of the updated Terms and Conditions.

Affiliates will be informed at least 24 hours prior to any changes made to their account via email.

12. Independent Relationship

Participation in the BestGrabBars Affiliate Program does not create a partnership, employment relationship, agency relationship, franchise relationship, or joint venture between BestGrabBars and the Affiliate.

Affiliates are independent parties responsible for their own activities, expenses, taxes, and compliance obligations.

13. Tax Information

Affiliates are solely responsible for complying with all applicable federal, state, and local tax laws relating to commissions earned through the BestGrabBars Affiliate Program.

To comply with applicable tax reporting requirements, BestGrabBars may require Affiliates to submit a completed IRS Form W-9 (or other applicable tax documentation) before commission payments are issued.

If required tax documentation is not received or is incomplete, BestGrabBars reserves the right to delay or withhold commission payments until the required information has been provided.

BestGrabBars may issue IRS Form 1099-NEC or any other required tax reporting documents as required by applicable law.

BestGrabBars may request tax documentation from Affiliates when required by applicable law.

14. Limitation of Liability

BestGrabBars is not responsible for indirect, incidental, special, or consequential damages arising from participation in the Affiliate Program.

BestGrabBars’ total liability related to the Program shall not exceed the total commissions paid to the Affiliate during the six (6) months immediately preceding the event giving rise to the claim.

15. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Wisconsin.

Any disputes arising from this Agreement shall be resolved in the state or federal courts located in Wisconsin.

16. Privacy and Tracking

BestGrabBars uses affiliate tracking software to manage and administer its affiliate program. By participating in the Affiliate Program, you acknowledge and agree that BestGrabBars may collect and process information necessary to administer the program, including but not limited to:

Your name and contact information;
Payment information necessary to issue commission payments;
Tax information when required by law;
Affiliate links, coupon codes, referral activity, clicks, conversions, and commission history;
Communications relating to your participation in the program.

Affiliate tracking may utilize cookies or similar technologies to attribute qualifying purchases to participating affiliates. Affiliates agree not to interfere with, manipulate, or attempt to circumvent the tracking system or commission attribution process.

Information collected through the Affiliate Program will be handled in accordance with the BestGrabBars Privacy Policy and will only be used for administering the program, processing commissions, complying with legal obligations, preventing fraud, and improving program operations.

17. Tracking, Reporting, and Commission Records

BestGrabBars uses affiliate tracking software to record referrals, coupon usage, qualifying purchases, and commission activity. While we strive to maintain accurate tracking, no tracking system is guaranteed to be error-free.

Commission eligibility will be determined solely by the records maintained by BestGrabBars and its affiliate tracking platform. These records shall be considered final and controlling in the event of any dispute regarding referrals, conversions, or commission payments.

It is the Affiliate’s responsibility to ensure that their affiliate links, promotional materials, and coupon codes are used correctly. BestGrabBars is not responsible for commissions that cannot be attributed due to broken links, disabled cookies, browser privacy settings, ad blockers, incorrect coupon usage, technical issues beyond our reasonable control, or any other circumstance that prevents proper tracking.
